Firm recovers landmark verdict calling for seatbelts on buses
November 3, 2005
On November 3, 2005, a jury in Waco, Texas returned a verdict of $17,583,247.00 for the plaintiffs in the case of Hinton et al v. Motorcoach Industries. Tom Brown and Larry Boyd, along with attorneys from Waco and Austin, represented bus passengers who were injured, and the families of those who were killed, when a charter bus overturned. The attorneys proved to the jury that the bus was unsafe because it lacked seatbelts and safety glass. Seatbelts and safety glass are not mandated on buses by the federal government. However, bus manufacturers are free to install the safety equipment on their buses. The jury found that seatbelts and safety glass are affordable and necessary measures to improve the safety of bus passengers.
This verdict is believed to be the first verdict in America in which a bus manufacturer has been held responsible for failing to make its buses safer.
